NCSD GOLF CLUB TERMS OF MEMBERSHIP:

CODE OF CONDUCT

NCSD Golf Club and its members shall create an environment and culture that is reflective of the personal integrity and respect documented in the Rules of Golf, where it is written that we are capable of enforcing rules upon ourselves with honesty, integrity, and good sportsmanship. The same integrity, honesty, and good will are expected by members, whether on the golf course, in the clubhouse or present on any other portion of the facility/property in use.

●         Acknowledges NCSD Golf Club as a family friendly environment and refrains from using obscenities, excessively loud or otherwise inappropriate behavior.

●         Is free of discrimination or any form of harassing behavior to fellow Club Members, golfers, visitors, or staff at the location being played.

●         Observes proper etiquette on and off the golf course when representing NCSD Golf Club.

●         Shows the utmost respect and dignity to fellow NCSD Golf Club Members, golfers, visitors, and staff at facilities being played.

●         Demonstrates an understanding that NCSD Golf Club members and guests have no authority to instruct course staff or course management of job performance and duties. If an NCSD Golf Club Member has an issue with course staff or course management, the member must report it to an NCSD Golf Board Member.

●         Is vigilant in reporting real or perceived safety hazards to NCSD Golf Board.

●         Is not to denigrate, talk down to, ridicule, or yell at fellow golfers, guests, or staff members at any location of an event and does not create unnecessary divisiveness in any way.

●         Does not misrepresent their position or authority to others.

●         Follows the published dress code.

●         Complies with all facility/property rules.

●         Complies with golf staff, restaurant staff, and maintenance staff at facilities being played/used.

●         Does not interfere with the ability of customers and/or staff to use the golf course for its intended purpose.

●         NCSD Golf Club Members and guests are personally responsible for damage caused by errant shots.

●         Acknowledges that at certain facilities only alcoholic beverages purchased on site are permitted on the premises and that privately-owned coolers may not be permitted on the premises.

Any NCSD Golf Club Member or Guest of NCSD Golf Club Member who violates or fails to observe the NCSD Golf Club Code of Conduct may be sanctioned as follows:

●         Issuance of a verbal warning.

●         Issuance of a written warning.

●         Suspension of his/her playing privileges for a defined period of time.

●         Permanent suspension of his/her NCSD Golf Membership and playing privileges.

●         Removal from the facility.

●         Monetary restitution for damage to property.

●         Forfeiture of all fees paid.

The NCSD Golf Board reserves the right to not have to follow the above steps in direct order for any conduct that the NCSD Golf Board deems egregious. If the violation is deemed severe by the NCSD Golf Board, the NCSD Golf Board may elect to suspend and/or expel without any refunds, any member without warning, of their NCSD Golf Club Membership and playing privileges.

WAIVER OF LIABILITY

Waiver and Release of Liability for NCSD Golf Club

In consideration of participating in any activities, events, outings, tournaments, or programs (collectively, the “Activities”) organized or sponsored by the NCSD Golf Club (the “Club”), including but not limited to playing golf at various golf courses in the area and competing in golf tournaments against other clubs, the undersigned participant (the “Participant”) acknowledges, agrees, and represents as follows:

1. Voluntary Participation

The Participant acknowledges that their participation in the Activities is entirely voluntary. The Participant understands that they are not required to participate and that they have the right to decline involvement at any time. The Participant affirms that they are in good health and physically capable of engaging in the Activities, or have consulted with a medical professional to confirm such capability.

2. Assumption of Risk

The Participant is aware that golf and related Activities involve inherent risks, dangers, and hazards, including but not limited to: physical exertion; weather conditions; uneven terrain; wildlife; equipment failure; collisions with other participants, objects, or vehicles; errant golf balls; and other unforeseen circumstances. These risks may result in serious injury, illness, disability, death, property damage, or other losses. The Participant knowingly and freely assumes all such risks, both known and unknown, even if arising from the negligence of the Club or others, and assumes full responsibility for their participation.

3. Release of Liability

The Participant, on behalf of themselves, their heirs, executors, administrators, assigns, and personal representatives, hereby fully and forever releases, waives, discharges, and covenants not to sue the Club, its officers, directors, members, volunteers, agents, affiliates, sponsors, and any golf courses or venues where Activities take place (collectively, the “Releasees”), from any and all claims, demands, actions, causes of action, liabilities, losses, damages, costs, expenses (including attorneys’ fees), or judgments of any kind arising out of or related to the Participant’s involvement in the Activities. This release includes, without limitation, any claims based on negligence, breach of contract, strict liability, or any other legal theory, whether known or unknown, foreseen or unforeseen.

4. Indemnification and Hold Harmless

The Participant agrees to indemnify, defend, and hold harmless the Releasees from and against any and all claims, demands, actions, causes of action, liabilities, losses, damages, costs, expenses (including attorneys’ fees), or judgments arising out of or related to the Participant’s participation in the Activities, including but not limited to any claims brought by third parties as a result of the Participant’s actions or omissions. This indemnification obligation shall survive the termination or completion of the Activities.

5. Additional Provisions

The Participant authorizes the Club to obtain or provide emergency medical treatment if necessary and agrees to be responsible for all associated costs.

The Participant grants the Club permission to use any photographs, videos, or recordings taken during the Activities for promotional purposes without compensation.

This Waiver shall be governed by the laws of the State of New York, without regard to conflict of laws principles.

If any provision of this Waiver is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

The NCSD Golf Club has no affiliation with the Nassau County Sheriff’s Department nor any of its entities and is an independent organization.

MEMBERSHIP ELIGILIBITY & REFUND POLICY

Board Approval Requirement: The NCSD Golf Club is a private organization. All "Sponsored" (non-NCSD) memberships for family or friends must receive formal Board approval prior to purchase.

Unauthorized Registrations: Any membership purchased for a non-NCSD individual without prior written authorization may be voided at the Board's sole discretion.

Non-Refundable Transaction Costs: In the event a registration is voided, a refund will be issued to the original payment method, less all non-refundable third-party transaction and processing fees. These fees are retained by the payment processor and are not recoverable by the Club. Deductions will include, but are not limited to:

  • Base Processing: 2.9% to 3.2% + $0.30 (Standard vs. Premium/Rewards Cards)

  • International Surcharge: Additional 1.5% (where applicable)

  • Currency Conversion: Additional 1.0% (where applicable)

Acknowledgment of Fees: By completing a purchase without prior authorization, the applicant acknowledges that total non-refundable deductions may exceed $8.00 per transaction and agrees to waive any claim against the NCSD Golf Club for the recovery of these merchant processing costs.

Acknowledgment:

The Participant has read the Code of Conduct, the Waiver of Liability, and the Membership Eligibility & Refund Policy in their entirety, understands their terms, and signs (digitally via form at point of sale) freely and voluntarily without inducement.

BY PAYING FOR THE NCSD CLUB FEES/MEMBERSHIP, THE INDIVIDUAL ACKNOWLEDGES AND AGREES TO COMPLY WITH THE CONDITIONS SET FORTH IN THE WAIVER OF LIABILITY, THE MEMBERSHIP ELIGIBILITY & REFUND POLICY, AND THE NCSD GOLF CLUB CODE OF CONDUCT.
